Terms of Service
Please read these terms carefully before using or engaging our services.
1. Services
Omkar Marine provides offshore & subsea engineering, inspection, repair & maintenance (IRM), marine equipment services, diving & ROV operations, salvage & wreck removal, emergency response, towage, subsea survey & mapping, and other related marine services.
2. Customer Obligations
Clients must provide accurate project details, ensure safe access to sites, and comply with all applicable permits and regulations. Omkar Marine shall not be held liable for delays or damages resulting from incomplete or inaccurate client information.
3. Quotations & Orders
All quotations are valid for 30 days unless otherwise stated. Changes in project scope, site conditions, or requirements may lead to adjustments in cost and timelines.
4. Payment Terms
Payments are due within 30 days of invoice unless otherwise agreed in writing. Late payments may incur interest at 1.5% per month. Applicable taxes and duties are the client’s responsibility.
5. Warranties & Liability
We warrant that services will be delivered professionally and in accordance with industry standards. Our liability is limited to the total contract value of the service provided. Omkar Marine shall not be liable for indirect or consequential losses including business interruption or loss of profits.
6. Health, Safety & Environment
Safety is a core value at Omkar Marine. Clients must cooperate with all safety protocols and provide a safe working environment. Hazards or incidents must be reported immediately.
7. Intellectual Property
All designs, drawings, reports, and technical documentation produced by Omkar Marine remain our property unless otherwise agreed in writing and may not be used outside the project scope without written consent.
8. Confidentiality
Both parties agree to maintain confidentiality of sensitive business and project information. This obligation continues for five (5) years after the completion or termination of services.
9. Termination
Either party may terminate the agreement with written notice in the event of a material breach not remedied within 30 days. Clients remain liable for payment of all services delivered up to the termination date.
10. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall fall under the jurisdiction of the courts of Karnataka, India. Both parties agree to attempt amicable resolution prior to legal action.
11. Changes to Terms
Omkar Marine reserves the right to update these Terms from time to time. Updates will be published on this page with the revised “Last Updated” date. Continued use of services constitutes acceptance of revised Terms.
